This matter is before the Court on Defendants’ Motion to Dismiss Plaintiffs Amended Complaint [Doc. 9].

I. Procedural Background

On March 21, 2011, Plaintiff Gary Stubbs filed his complaint in the Superior Court of Fulton County, Georgia, seeking cancellation of a foreclosure sale and dam*1268ages based on his wrongful foreclosure claim. Defendants Bank of America, BAC Home Loans Servicing, LP (“BAC”), and Federal National Mortgage Association (“Fannie Mae”) removed the action to the Northern District of Georgia based on diversity jurisdiction on April 27, 2011.
