Scott Graves, a City Councilor of Gardner, Massachusetts, brings claims for declaratory judgment and mandamus relief, and certiorari against the defendants, the City of Gardner and Mark Hawke, its Mayor. Councilor Graves alleges that Mayor Hawke improperly submitted an emergency medical services zone plan to the Department of Public Health without having been empowered to do so by the City Council.
