Defendant moved for and was granted rehearing of Issue ii of the Court’s opinion in Akyan v Auto Club Ins Ass’n, 207 Mich App 92; 523 NW2d 838 (1994), addressing the effect in this civil action for breach of an insurance contract of plaintiff’s plea of nolo contendere to a criminal charge. That opinion is herein adopted with regard to Issue i, and clarified and expanded with regard to Issue ii.
