On October 31, 1995, the Ohio Department of Administrative Services (“ODAS”)' filed a complaint in the Franklin County Court of Common Pleas against Robert P. Madison International, Inc., Miles-McClellan Construction Company, and Forest City Erectors. ODAS set forth claims of breach of contract and negligence arising from the design and construction of a main computer facility that would house most of the state’s mainframe computers.
