The plaintiff brings this action to recover the sum of $10,000.00 from the Maryland Casualty Company upon an automobile liability insurance policy which was issued on behalf of the Yellow Cab Company, a corporation, the insured námed therein, pursuant to the provisions of Section 49-1833 NDRC 1943. The Yellow Cab Company is a common carrier of passengers for hire operating under authority of a certificate of public convenience and necessity issued by the Public Service Commission of the State of North Dakota.
