Appeal from a judgment of the superior court for Pierce county, Mitchell, J., entered July 9, 1913, upon an agreed statement of facts, in favor of the plaintiff, in mandamus proceedings to secure salary warrants.

The legislature of the state of Washington, at the biennial session of 1907, passed an act relating to the salaries of the judges of the supreme and superior courts ; increasing outright the salaries of the one, and making the following provision with relation to the other.
“Each judge of the superior court shall receive an annual salary of three thousand dollars: Provided, that in counties of the first class said salary may be increased by order of the board of county commissioners to an amount not exceeding four thousand dollars.
