KENNEDY, District Judge.

This is a suit in which the plaintiffs seek relief from alleged illegal taxes assessed by -the defendant Board under the provisions of the State Sales and Use Tax statutes of the State of Wyoming. The relief sought is based upon two distinct phases claimed to give this court jurisdiction. The first phase or cause of action is founded on the Federal Declaratory Judgment statute, 28 U.S.C.A. § 400, and' the • second -is for conventional relief in equity authorized by 28 U.S.C.A. § 41 (1).
