The plaintiff-appellee, Health Care Authority of the City of Huntsville d/b/a Huntsville Hospital (the hospital), filed this action in the Circuit Court of Madison County, Alabama. Subsequently, the defendant-appellant, Mor-tara Instrument (Mortara), filed a notice of removal to the United States District Court for the Northern District of Alabama, Northeastern Division, on diversity grounds. The district court, after hearing ore tenus evidence, entered a Judgment and Memorandum Opinion in favor of the hospital. We affirm.
