The parties will be referred to as they appeared in the trial court. Plaintiff instituted the action in the district court of Las Animas County to recover freight charges claimed to be due and owing for transportation of a carload of barley from Hayden, Colorado, to Trinidad. The complaint alleged that the amount of $852.84 was due and unpaid. The defendants were partners in the Bancroft-Marty Feed and Produce Company in Trinidad, Colorado.
