This is an appeal from a jury verdict in favor of plaintiff in an action to recover damages brought in the district court of the-sixteenth judicial district, county of Custer. Defendant moved for a judgment notwithstanding the verdict and for a new trial. Both motion were denied.

Hereinafter, plaintiff George Waddell will be referred to as Waddell, and defendant. American Breeders Service, Inc will be referred to as ABS.
