Appeal from an order of the Supreme Court (Spain, J.), entered May 23, 1994 in Rensselaer County, which, inter alia, denied defendants’ motion for summary judgment dismissing the complaint.
Plaintiff, an attorney admitted to practice law in New York, resigned his position as an Assistant District Attorney in Rensselaer County on January 5, 1993, one day after his appointment to that position by the District Attorney of Rensselaer County.
