Order unanimously modified on the law and as modified affirmed with costs to plaintiff, in accordance with the following memorandum: Plaintiff, an attorney, was indicted by a Monroe County Grand Jury and charged under former section 155.35 of the Penal Law with one count of grand larceny in the second degree. Specifically, the indictment charged that plaintiff "stole property belonging to NEC Home Electronics”, the value of which exceeded $1,500.
