Appeal from a judgment of the Appellate Division of the Supreme Court in the first judicial department, entered July 21, 1906, affirming a judgment in favor of plaintiff entered upon a verdict and an order denying a motion for a new I rial. The action is brought on an employer’s liability insurance policy whereby the Flew York Transfer Company, a joint stock association, of which the plaintiff is president, was indemnified against liability for injuries to persons or property resulting from any accident caused by the horses or vehicles of the insured in the transportation of goods or freight.
