The appellee (plaintiff below), on August 30, 1914, at about one o ’clock p. m., was thrown under a passenger train operated by appellants (defendants below) in the town of Neon, Letcher county, Kentucky, and his left leg was so mangled and crushed by the wheels of the train running over it that it had to be and was amputated just above the knee; to recover damages for his injuries he brought this suit against both defendants, Louisville & Nashville Railway Company and Lesington & Eastern Railway Company.
