FACTS AND PROCEDURAL HISTORY

¶ 1. Joseph Young and James Merritt were involved in an automobile accident on March 30, 2006. On June 7, 2007, Young filed a complaint against Merritt in the Circuit Court of Coahoma County, alleging negligence for damages that resulted from the accident.

¶ 2. On August 1, 2007, Merritt filed his answer and affirmative defenses. Merritt also propounded written discovery. At some point during this time, Young’s counsel lost contact with Young. When no response was received from Young, Merritt’s counsel sent follow-up letters on September 27,…
