This is an appeal from an order of the court overruling a demurrer to the petition in an action against the surety on the *749bond of a trustee. Two previous cases in this court (Ryan v. Scovill, 140 Kan. 588, 37 P. 2d 1007, and Scovill v. Scovill, 144 Kan. 759, 62 P. 2d 852) involve different phases of the same controversy. The allegations of the petition may be summarized as follows: Addie Seovill obtained a divorce from her husband, Fred Seovill, January 14, 1919.
