This is a motion for the dismissal of the complaint on the grounds that the action cannot be brought by reason of the .Statute of Limitations. The complaint alleges that the defendants in or about the years 1966 and 1967 prepared Federal and New York State income tax returns on behalf of the plaintiffs which were filed by the plaintiffs. The complaint further alleges negligence in the preparation of said returns resulting in an overas.sessm.ent of taxes against the plaintiffs in the amount of $8,069.16.
