INMAN, Judge.

Willie Jenkins ("Defendant") appeals from a judgment entered after a jury convicted him of breaking or entering a motor vehicle, misdemeanor larceny, and communicating threats, and after, he pleaded guilty to attaining the status of an habitual felon. On appeal, Defendant argues that the trial court erred by: (1) denying his motion to dismiss and finding no fatal variance between the indictments and the evidence presented at trial, (2) failing to instruct the jury on a lesser-included offense, and (3) failing to clarify terminology used during jury instruction.
