Losing, Chief Justice.

This is an action in tort brought initially against the J. L. Shiely Company to recover damages for personal injuries. On motion of the J. L. Shiely Company, the trial court ordered that the Steen-berg Construction Company be made a party defendant. This action came on for trial before a jury, which returned a verdict against both defendants and assessed plaintiff’s damages at the sum of $40,000. Each defendant moved for judgment notwithstanding the verdict or a new trial, and these motions were, in all respects, denied. Each defendant has appealed from the order denying…
