On Sunday, April 7, 1968, parts of Baltimore City were beset by massive rioting of such intensity that the Governor of Maryland imposed a 4:00 p.m. city-wide cur few under the emergency powers vested in him by Maryland Code, Article 41, Section 15B. 1

At 7:30 p.m. appellant was observed by police as he' was'about to enter his parked car and, along with four other occupants of the vehicle, was arrested for violating the curfew — a misdemeanor under the statute.
