Plaintiff is the husband of Helen Edelbrock, deceased, and as administrator of her estate attempts by this action to recover damages for her death. Under the amended complaint, upon the theory *26of which the case was submitted to the jury, recovery was sought under the Minnesota Employers Liability Act, chapter 187, p. 253, Laws 1915, under which contributory negligence is not a defense, but goes only in reduction of damages.
