(After stating the foregoing facts.) From 1777 until 1877 the General Assembly was authorized to lay out new counties whenever in its judgment it was necessary for the public welfare. The power to lay out new counties was expressly recognized in the earlier constitutions of the State, and was never taken away by any of the later constitutions until 1877. The last exercise of this power prior to the adoption of the present constitution was the creation of the county of Oconee in 1875, just two years before the convention assembled which declared that no new counties should thereafter be…
