SWAN, Circuit Judge.

The appellant was tried with one Joseph Einhorn 'under an indictment which charged, in the first count, that they conspired together to violate the Bankruptcy Act, 11 U.S.C.A. § 52, by concealing assets from the trustee in bankruptcy of Finchley Art Shops, Inc., by transferring assets of that corporation in contemplation of its bankruptcy and with intent to defeat the Act, and by concealing, mutilating and falsifying books and records of the bankrupt.
