Plaintiff Local 1239, International Brotherhood of Boilermakers, Iron Shipbuilders, Blacksmiths, Forgers and Helpers (“Local 1239”), along with several of its members individually and on behalf of similarly situated members of Local 1239, have sued under the Worker Adjustment and Retraining Notification Act (the ‘WARN Act”), 29 U.S.C. § 2101-2109, alleging that defendant Allsteel, Inc.
