This matter comes before the Court on defendant’s Motion for Summary Judgment (doc. 39), with incorporated memorandum of law and accompanying exhibits.1 An Order (doc. 41) entered on March 2, 2011 directed any party opposing the Motion to file a response on or before March 28, 2011.
