Affirming.
These two appeals involve the constitutionality of subsection 42, section 3290, Kentucky Statutes. The subsection in question is chapter 53, Acts 1914, and is as follows:
“An act to 'amend section.3290 in subdivision 2 of Article 4, Chapter 89, Kentucky Statutes, and providing for the oiling of streets in' cities of the third class.
