Tbe complaint in tbis action avers that in negotiations for tbe purchase of a farm by tbe plaintiff from tbe defendant, witb intent to deceive and defraud tbe plaintiff tbe defendant falsely and fraudulently represented that tbe farm contained 160 acres of land, although tbe defendant well knew that it contained only 152.81 acres. Tbe plaintiff relied upon such representations and was thereby induced to and did purchase said farm and agreed to pay to defendant for tbe same $76 per acre, which amounted to-$12,160. All of tbis has been .paid…
