Appellant was charged by information with murder in the first degree for the killing of his wife on December 9,1937, by shooting her with a pistol. Trial to a jury resulted in a verdict of guilty of manslaughter and his punishment fixed at seven years imprisonment in the State penitentiary, on which .judgment was accordingly entered.
