This is an action to establish a claim against the receiver of a failed bank. The trial court made'findings of fact and rendered judgment for defendant. Plaintiff has appealed.

Briefly, the facts may be stated thus: For many years prior to March 21, 1928, when it was closed by order of its board of directors, taken charge of by the bank commissioner, and the defendant receiver was appointed, the Citizens State Bank of Sabetha had been transacting a general banking business, and F.
