The relator was indicted by a grand jury of the County of Cattaraugus for the crime of murder in the first degree alleged to have been committed September 16, 1939, in the city of Salamanca in said county. He was convicted upon the second count of the indictment which charged a lnllino’ by the relator while engaged in the commission of a robbery.
