Appeal from an order of the Supreme Court (Caruso, J.), entered October 13, 2004 in Schenectady County, which denied defendant’s motion for summary judgment dismissing the complaint.
On September 13, 2001, while employed as a United Parcel Service driver, plaintiff was injured on defendant’s property on Cordell Road in the City of Schenectady, Schenectady County.
