This is an action brought to recover for a loss claimed to have accrued under a policy of insurance. The insured *556had judgment below, and the case is brought to this court upon error by the insurance company. The single question presented and requiring consideration is the validity of a provision in the policy making a submission of the question of the amount of loss to arbitrators, and an award thereon, a condition precedent to the right to maintain an action.
