Appeal by the plaintiff, Herbert Hutchinson, from an order of the-Supreme Court, made at the Jefferson Special Term and entered in the office of the clerk of the county of Jefferson on the 10th day of July, 1906, striking out a portion of the complaint as irrelevant and redundant.

Nash, J.:
The action is for assault and battery. . The first count of the complaint alleges that the said defendant, at the town of Orleans, county of Jefferson, H. Y., on or about the 27th day of April, 1905, with force and arms, assaulted this plaintiff, and then and there, with force and violence, seized and laid hold of the said plaintiff, and did then and there strike and beat the said, plaintiff on the head with his fist, and did then aiid there with drawn knife assault the said plaintiff, and did chase the said plaintiff across, the lands belonging to the said defendant; that said…
