Order, Supreme Court, Bronx County (Patricia Anne Williams, J.), entered February 22, 2011, which, to the extent appealed from, denied defendants-appellants’ motion pursuant to CPLR 3211 (a) (7) and 3212 to dismiss plaintiffs 42 USC § 1983 cause of action, unanimously reversed, on the law, without costs, and the motion granted.
