In this case, the court must determine whether the refusal of the State of Wisconsin, Department of Transportation (State), to reinstate the discharged debtor’s drivers license in the absence of proof of financial responsibility, as required by section 344.-26, WIS.STAT., constitutes improper governmental discrimination, contrary to 11 U.S.C. § 525. 1 The issue presented is to be decided on the State’s motion to dismiss for failure to state a claim upon which 'relief can be granted.
