MEMORANDUM AND ORDER

NEWCOMER, District Judge.

This action was instituted by plaintiff, on behalf of herself and all others similarly situated, to challenge certain provisions of Pennsylvania’s Financial Responsibility Law, 75 Pa.C.S.A. § 1701 et seq. (hereinafter the “Act”) as they are applied to persons who have had tort judgments discharged in bankruptcy. 1 The issue before this Court is whether certain provisions of the Act are unconstitutional because they conflict with the purposes of the Bankruptcy Code 11 U.S.C. § 525 and therefore run afoul of the Supremacy Clause of the United States…
