Appeal from a judgment of the Appellate Division of the Supreme Court in the fourth judicial department, entered April 16, 1917, affirming a judgment in favor of plaintiff entered upon a verdict directed by the court. March 30, 1900, the defendant issued a policy of insurance to Electric Light and Power Company of Syracuse, hereinafter denominated Power Company, whereby defendant agreed to indemnify the Power Company for one year against loss from common law or statutory liability for damages on account of bodily injuries fatal or non-fatal suffered by any person or persons not employed by the assured and occurring within the factory, shop or yards described in the application, or upon the ways immediately adjacent thereto, provided for the use of employees, or the public, and caused by the negligence of…
