GILL, Associate Justice.

This was an action of trespass to try title brought by Wm. L. Moody, Jr., against E. C. Ogden for the recovery of 1280 acres of land situated in San Jacinto County, Texas. Defendant answered by a plea of not guilty and limitation of three, five and ten years. The case was tried to the court without a jury and resulted in a judgment for defendant, from which plaintiff prosecutes this appeal.
