CARDAMONE, Circuit Judge:
Defendant Rafael Peralta appeals from a judgment of conviction entered on March 8, 1996 after a jury trial in the United States District Court for the Southern District of New York before Judge Robert P. Patterson. Peralta was convicted of conspiring to distribute and possess with intent to distribute heroin and distributing and possessing with intent to distribute heroin, in violation of 21 U.S.C. §§ 812, 841(a)(1), 841(b)(1)(B) and 846.
