The plaintiffs and appellants in this action claim to he the heirs at law of one Frank V. Silva, deceased. The defendant is the sole distributee of Silva’s estate under á decree of distribution made pursuant to his will, duly probated, whereby he gave all his property to the defendant. The estate was of very considerable value and comprised both real and personal property. By the action the plaintiffs seek to charge the defendant with a constructive trust in their favor as to the property which she so received.
