BENTON, Judge.

In April 1988, while criminal charges were pending against appellant Robert Ber-della, he retained respondent Sharlie Pen-der, an attorney, to act as his agent to keep his personal financial affairs in order during his pretrial confinement. Following appellant’s conviction for first degree murder, forcible sodomy, and felonious restraint, Christopher Bryson — an individual with a suit, arising from appellant’s conviction, pending against appellant — filed for the appointment of a trustee pursuant to Chapter 460, RSMo 1986.
