In this diversity case involving claims of race discrimination under Louisiana’s anti-discrimination statute, La.R.S. 23:1006, defendant-appellant National Tea Company appeals the Magistrate Judge’s denial of its motion for attorney’s fees and damages relative to plaintiff’s failure to reclassify claim, which claim was dismissed at trial on defendant’s Rule 41(b) motion, and appeals the award of $10,098 in attorney’s fees to plaintiff, who prevailed at trial on her failure to promote claim but whose damage award was only $4,000.
