Defendant appeals the trial court’s order that (1) held that he was not entitled to immunity under § 4 of the Michigan Medical Marihuana Act (MMMA), MCL 333.26424, and (2) denied defendant’s requests for dismissal under § 8 of the MMMA, *251MCL 333.26428, and to present a § 8 defense at trial. For the reasons set forth in this opinion, we affirm.

I. NATURE OF THE CASE
