JACKSON, Chief Justice.

The record discloses that in 1924 and 1925, as well as prior and subsequent thereto, J. R. Germany was City Tax Collector and City Secretary of the City of Lubbock, a municipal corporation; that on or about August 13, 1923, the Fidelity and Deposit Company of Maryland executed and delivered to the City its bond in writing wherein it agreed to pay the City for any loss of moneys, securities or personal property not exceeding $10,000 resulting from any fraud, dishonesty, larceny, embezzlement, forgery, misappropriation, wrongful abstraction or wilful misapplication of the…
