Appellants Donald Daugherty and Forrest Hall are the sole owners and officers of P & M Coal Company (“P & M”). The question before us is whether Daugherty and Hall, by virtue of their status as owner-officers, are “employers” within the meaning of Title IV of the Employee Retirement Income Security Act of 1974 as amended (“ERISA”), and as such jointly responsible for the statutory liability incurred by P & M on its withdrawal from two multiemployer pension plans.
