The action was commenced about the 19th day of September, 1900, by the service of a summons and complaint upon the defendant, in the city of Washington, District of Columbia, by a citizen whose name was G. Russell Cain, although the defendant refused to accept such service. On the 21st day of February, 1901, upon the affidavit of said G. Russell Cain, made before a notary public in and for the said District of Columbia, and upon the affidavit of William N.
