This is an appeal of an Order entered on February 16, 1988, 1 by the Bankruptcy Court granting Sun Bank of Tampa Bay’s (Sun Bank) motion for relief from the automatic stay.
The facts of this case are straightforward. Prior to the institution of any bankruptcy proceedings, Sun Bank filed a complaint in state court seeking to foreclose a mortgage which it held on the principal residence of the Debtor.
