Statement of the case. This was an action in the nature of ejectment, brought by James Clayton against School District No. 1 of Barton county, for the recovery of lot No. 9 in block No. 89 in the city of Great Bend. The plaintiff in his amended petition alleged that he was the owner in fee simple of said was entitled to the possession thereof, and that the defendant unlawfully kept him out of the possession.
