' This is an appeal from the district court of •Wagoner county. On April 5, 1909, the plaintiff in error, hereinafter referred to as -the “plaintiff”, commenced this action in the district court of Wagoner county, against the defendants in error, hereinafter referred tó as the “defendants,”" to recover possession of 40 acres of land, and damages for the wrongful and unlawful possession thereof.
