ROVIRA, Justice.

This is an appeal by the People, who challenge the dismissal of a theft charge against the defendant. The basis for dismissal was the trial court’s finding that the defendant was denied a speedy trial pursuant to section 18-1-405, C.R.S.1973 (1978 RepLVol. 8). We disagree, and direct that the charge be reinstated.
